These Terms of Service govern your access to and use of the Chambre d’Arômes website, online store, products, services, and related features.

Throughout these Terms, “Chambre d’Arômes,” “we,” “us,” and “our” refer to Chambre d’Arômes. “You” and “your” refer to any visitor, customer, purchaser, or user of this website.

By visiting our website, creating an account, submitting information, or purchasing a product, you agree to these Terms of Service and any policies referenced within them. Please do not use the website if you do not agree to these Terms.

1. Online Store Terms

You must be legally capable of entering into a binding agreement to use this website or place an order.

You may not use our website, products, or services for any unlawful, fraudulent, abusive, or unauthorized purpose. You may not violate any applicable federal, state, local, or international law while using the website.

You may not transmit viruses, malicious code, automated scraping tools, or other technologies that could damage, disrupt, or interfere with the website or another user’s experience.

2. Products and Fragrance Information

Chambre d’Arômes offers a curated selection of niche, artisanal, and luxury fragrances.

We make reasonable efforts to describe and display products accurately. However:

• Product colors, packaging, bottle designs, labeling, and presentation may appear differently depending on your screen or may be updated by the manufacturer.
• Fragrance perception is subjective and may vary based on skin chemistry, environment, application, and individual sensitivity.
• Descriptions of notes, longevity, projection, mood, season, or occasion are provided as general guidance and are not guarantees.
• Product images may include props, styling elements, or packaging that are not included with the purchase.

We reserve the right to correct product descriptions, images, pricing, availability, or other information at any time.

3. Product Availability

All products are subject to availability.

We may:

• Limit quantities available for purchase
• Restrict sales to certain individuals, geographic areas, or jurisdictions
• Discontinue products without notice
• Cancel orders for products that are unavailable
• Limit purchases of limited-edition, high-demand, or restricted items

Adding a product to your cart or wishlist does not reserve inventory.

If an ordered product becomes unavailable, we may contact you to offer an alternative, revised fulfillment date, partial fulfillment, or refund.

4. Pricing

Prices are displayed in U.S. dollars unless otherwise stated.

We reserve the right to change prices at any time without notice. Price changes do not affect orders already accepted unless there was an obvious pricing or technical error.

Taxes, shipping charges, and other applicable costs are calculated and displayed during checkout.

We are not obligated to honor a price that was clearly posted in error. If a pricing error affects your order, we may contact you for instructions or cancel and refund the affected purchase.

5. Orders and Acceptance

Submitting an order does not guarantee acceptance.

We may refuse, limit, or cancel an order for reasons including:

• Product unavailability
• Suspected fraud or unauthorized activity
• Incorrect pricing or product information
• Payment authorization failure
• Shipping restrictions
• Inventory discrepancies
• Unusually large or repeated orders
• Suspected resale or commercial redistribution
• Violation of these Terms

If we cancel an order after payment has been collected, we will issue an appropriate refund to the original payment method.

You agree to provide complete and accurate billing, shipping, contact, and payment information.

6. Payments

Payment must be completed using one of the payment methods made available during checkout.

By submitting payment information, you represent that:

• You are authorized to use the selected payment method
• The information provided is complete and accurate
• You authorize the applicable charge, including taxes and shipping

Payment processing may be performed by Shopify and third-party payment providers. Their separate terms and privacy practices may apply.

Chambre d’Arômes does not guarantee that every payment method will remain available at all times.

7. Shipping and Delivery

Orders are generally processed within 1–2 business days. Processing may take longer during holidays, launches, promotions, severe weather, inventory delays, or periods of unusually high volume.

Complimentary standard shipping may be available for qualifying U.S. orders over the threshold displayed on the website.

Shipping dates and delivery estimates are not guaranteed.

You are responsible for providing a correct and complete shipping address. We are not responsible for delays or losses caused by an inaccurate address submitted by the customer.

Once an order is transferred to a shipping carrier, delivery may be affected by circumstances beyond our control.

8. In-Store Pickup

Eligible customers may select in-store pickup during checkout when the option is available.

Pickup orders are not ready until the customer receives a confirmation stating that the order is ready.

Customers may be required to present:

• Order confirmation
• Government-issued identification
• The payment card used for the purchase, where appropriate

We may decline to release a pickup order when identity or authorization cannot reasonably be verified.

Pickup availability depends on inventory at our Delray Beach boutique.

9. Returns, Exchanges, and Refunds

Due to the personal and cosmetic nature of fragrance products, all sales are final, except where otherwise required by law or expressly provided in our Refund and Return Policy.

We do not accept returns or exchanges based on personal fragrance preference, scent compatibility, longevity, projection, change of mind, or ordering the incorrect product.

Damaged, defective, missing, or incorrect items must be reported within the period stated in our Refund and Return Policy.

Our full Refund and Return Policy is incorporated into these Terms.

10. Order Changes and Cancellations

Orders may begin processing shortly after they are placed.

You may contact us to request a cancellation or correction, but we cannot guarantee that a change can be completed after processing begins.

Orders that have been packed, transferred to a carrier, or completed through pickup cannot be cancelled.

11. Customer Accounts

You may be able to create a customer account to view orders, save information, or access other features.

You are responsible for:

• Keeping your login credentials confidential
• Providing accurate account information
• Restricting access to your account and devices
• Notifying us promptly of suspected unauthorized access

You may not impersonate another person, create an account using false information, or use another customer’s account without permission.

We may suspend or terminate accounts associated with fraud, abuse, unauthorized use, or violations of these Terms.

12. Wishlist and Saved Products

Wishlist and saved-product features are offered for convenience.

Adding an item to a wishlist does not:

• Reserve inventory
• Lock in a price
• Guarantee future availability
• create an obligation for us to sell the item

Wishlist data may depend on cookies, browser storage, account status, or theme functionality and may not remain available indefinitely.

13. Fragrance Consultations and Recommendations

Our team may provide fragrance suggestions based on information you share regarding scent preferences, mood, occasion, lifestyle, or prior fragrances.

Recommendations are subjective and are not guarantees that you will prefer a product or experience a specific level of longevity, projection, or performance.

Consultations are informational shopping services and are not medical advice.

Customers with allergies, sensitivities, asthma, skin conditions, pregnancy-related concerns, or other health concerns should review product ingredients and consult a qualified healthcare professional before use.

14. Product Use and Safety

Fragrance products should be used only as directed.

You are responsible for reviewing product ingredients, manufacturer warnings, and usage instructions before application.

Avoid contact with eyes, ingestion, open flames, damaged skin, and other uses not intended by the manufacturer.

Discontinue use if irritation or an adverse reaction occurs.

To the fullest extent permitted by law, Chambre d’Arômes is not responsible for adverse reactions caused by individual allergies, sensitivities, misuse, improper storage, or failure to follow manufacturer instructions.

15. Gift Purchases

Gift purchases remain subject to our final-sale policy.

The purchaser is responsible for verifying:

• The recipient’s shipping address
• Product selection
• Fragrance preferences
• Any gift message entered during checkout

We do not guarantee that a recipient will prefer or tolerate a selected fragrance.

16. Discovery Sets and Samples

Discovery sets, samples, travel sizes, and promotional products may have limited availability and may be subject to separate purchase limits.

Unless expressly stated otherwise, discovery sets and samples are final sale and may not be returned or exchanged.

Samples shown in images or marketing materials are not included unless specifically listed in the product description or order confirmation.

17. Promotions and Discount Codes

Promotions and discount codes:

• May be limited in duration
• May apply only to certain products or orders
• May require a minimum purchase
• May exclude specific brands, launches, or limited editions
• May not be combined unless expressly stated
• Have no cash value
• May be modified or discontinued at any time

Discounts cannot normally be applied retroactively to completed purchases.

We may cancel promotions or orders involving misuse, fraud, duplicate accounts, technical errors, or unauthorized code distribution.

18. Reviews, Comments, and User Content

If you submit a review, photograph, comment, testimonial, message, social-media tag, or other content, you represent that:

• You own the content or have permission to provide it
• The content is truthful and based on your genuine experience
• It does not violate another person’s rights
• It is not unlawful, defamatory, threatening, obscene, deceptive, or malicious
• It does not contain malware, spam, or unauthorized advertising

To the extent permitted by law, you grant Chambre d’Arômes a nonexclusive, royalty-free, worldwide license to use, reproduce, display, edit, and share submitted content in connection with our website, business, and marketing.

We may remove or decline to publish content at our discretion, but we are not obligated to monitor all submissions.

19. Intellectual Property

The website and its contents—including text, branding, graphics, layouts, photographs, videos, icons, and design elements—are owned by, licensed to, or used with permission by Chambre d’Arômes.

Brand names, logos, product photographs, trademarks, and other materials belonging to fragrance houses remain the property of their respective owners.

You may use the website only for personal, noncommercial shopping purposes.

You may not reproduce, copy, distribute, modify, scrape, publish, sell, exploit, or create derivative works from website content without written permission.

20. Prohibited Uses

You may not use the website to:

We are not obligated to update every statement unless required by law.

We do not guarantee that the website will always be available, uninterrupted, secure, or error-free.

We may suspend, modify, restrict, or discontinue any part of the website for maintenance, security, updates, or business reasons.

24. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the website and its contents are provided on an “as available” and “as is” basis.

We do not warrant that:

• Every product will remain available
• Fragrance performance will be identical for every customer

Nothing in these Terms excludes any warranty or consumer right that cannot lawfully be excluded.

25. Limitation of Liability

To the fullest extent permitted by law, Chambre d’Arômes and its owners, employees, representatives, affiliates, service providers, and agents will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from:

• Product selection or personal fragrance preference
• Website interruption
• Unauthorized account access
• Third-party services
• Lost profits, data, or opportunities
• Shipping delays outside our reasonable control

Where liability cannot legally be excluded, our liability will be limited to the extent permitted by applicable law.

Nothing in these Terms limits liability that cannot lawfully be limited.

To the extent permitted by law, you agree to indemnify and hold harmless Chambre d’Arômes and its owners, employees, representatives, affiliates, and service providers from claims, losses, liabilities, and reasonable costs arising from:

The Privacy Policy is incorporated into these Terms by reference.

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules, except where applicable consumer law requires otherwise.

Any dispute relating to these Terms, the website, or a purchase will be handled in a court of competent jurisdiction, subject to any rights that cannot legally be waived.

Because dispute-resolution, venue, arbitration, and class-action waiver provisions can have significant legal consequences, I have intentionally not inserted aggressive mandatory-arbitration language into this draft. The client’s Florida attorney should decide whether those clauses are appropriate.

30. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

31. Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision later.

32. Entire Agreement

These Terms, together with the policies incorporated by reference, constitute the agreement between you and Chambre d’Arômes regarding your use of the website and purchases through the online store.

33. Changes to These Terms

We may update these Terms periodically by posting the revised version on the website and changing the “Last updated” date.

Your continued use of the website after an update constitutes acceptance of the revised Terms to the extent permitted by law.
